In Orphans of the Living: Stories of America's Children in Foster Care, journalist Jennifer Toth exposed some sobering facts:
* Social workers under-report the numbers of children subjected to abuse in their biological homes, and fail to investigate many abuse cases.
* Most children in foster care were physically or sexually abused before they entered the system.
* The frequency of abuse is even higher in foster homes, because social services agencies do not adequately screen or supervise foster parents.
* Because of a "desperate shortage of resources" in the system, caseworkers often "put children in the first available placement rather than one the child deserves."
The system, Toth concluded, is "tired and destructive,... a failure."
The system is unlikely to change, however, unless it is legally accountable. In North Carolina and elsewhere, local governments often claim immunity when their agencies damage the very children and families they are supposed to protect.
